
Terms of Service
The terms governing access to and use of TOF Data System, operated by The OpenTree Foundation ("OTF", "we", "us").

1. Acceptance of these terms
These Terms of Service (the “Terms”) govern your access to and use of TOF Data System (the “System”), available at askjay.opentree.org. By signing in to or using the System, you agree to be bound by these Terms. If you do not agree, you must not access or use the System.
2. The service
The System is an internal enterprise resource planning application provided by The OpenTree Foundation to support its programmes and administration. It is made available solely for OTF’s business purposes and only to authorised users. We may add, change, suspend, or remove features at any time without notice.
3. Eligibility and authorised access
Access is restricted to approved accounts on permitted email domains and is granted at OTF’s discretion. New accounts require administrator approval before access is enabled. You may use the System only with an account you are authorised to use, and only for the role and permissions assigned to you. Sharing accounts or credentials is not permitted.
4. Acceptable use
You agree not to:
- access data or features beyond the permissions assigned to your account, or attempt to circumvent access controls;
- enter false, misleading, or unlawful information into the System, or tamper with records you are not authorised to change;
- use the System to violate any law or any OTF policy, or to infringe the rights of others;
- interfere with, disrupt, probe, or attempt to gain unauthorised access to the System or its underlying infrastructure; or
- copy, export, or disclose data from the System except as necessary to perform your authorised duties.
5. Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify OTF immediately if you suspect any unauthorised use of your account or any other breach of security. Activity in the System is logged for security and accountability.
6. Confidentiality and data
Information held in the System — including programme, partner, staff, and operational data — is confidential and the property of, or entrusted to, The OpenTree Foundation. You must treat it as confidential, use it only for authorised purposes, and not disclose it to anyone not entitled to receive it. Your use of the System is also subject to our Privacy Policy, which explains how we handle personal information.
7. Intellectual property
The System, including its software, design, and content (excluding data you or OTF input), is owned by The OpenTree Foundation or its licensors and is protected by applicable laws. These Terms do not grant you any right, title, or interest in the System other than the limited right to use it as authorised.
8. Third-party services
The System relies on third-party providers (including Google for sign-in, and cloud infrastructure and communication providers) to operate. Your use of those services through the System may be subject to their respective terms. We are not responsible for third-party services we do not control.
9. Disclaimer of warranties
The System is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the System will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, The OpenTree Foundation will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the System.
11. Suspension and termination
We may suspend or terminate your access to the System at any time, with or without notice, including if we believe you have violated these Terms or if your authorisation to access OTF systems ends. Upon termination, your right to use the System ceases immediately. Provisions that by their nature should survive termination will survive.
12. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the System after changes take effect constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the competent courts of India.
